The District Court of New York, upon considering the motion to dismiss and claim´s moot allegations submitted by Acciona´s lawyers, the law-firm Wachtell, Lipton, Rosen & Katz, has ordered that the Discovery agreed in the Court conference of October 13 will not proceed further and has not imposed any of the other injuctions sought by E.ON.

The Court has required E.ON to clarify and build up its legal and factual allegations supporting its accusations and to answer Acciona´s motions, both parties having been summoned for a new conference that will take place on November 16. 

Since the injuctions sought by E.ON have not been granted, ACCIONA faces no restrain whatsoever in its strategy regarding ENDESA´s investment.
